FINALLY, they are getting to the trial for the girl that was gang raped at a Richmond, CA High School Homecoming Dance

MARTINEZ (KRON) — Richmond Police Officer Jeff Whitson is testifying in the October 2009 gang rape of a 16-year-old outside a high school’s homecoming dance.

In court on Tuesday afternoon, Officer Whitson said that he transported one of the defendants, Manuel Ortega, a 20-year-old Richmond resident, to a booking facility the night of the incident.

In his testimony, Whitson said that while he took Ortega to the booking facility and while there, the defendant said “I didn’t rape her,” KRON 4’s Dan Kerman reported.

The officer said that Ortega told him “She was so drunk, she didn’t know what was going on.” Ortega then said “I wasn’t the only one, there was hella people” and “She wanted it. [Jane Doe] wanted it.”

Dan reports that in his testimony, the police officer said that Ortega was belligerent both while they were trying to handcuff him and getting DNA evidence from him. Whitson explained that they took a swab of DNA from his mouth and some pubic hair.

Whitson said that Ortega wasn’t cooperative. The officer also said that the defendant appeared to be intoxicated.

Earlier on Tuesday, Richmond police Officer Gary Lewis also testified. He said he arrested Manuel Ortega as he was fleeing from the school shortly after the victim was found unconscious under a picnic table.

As he was driving east on Rheem Avenue near 24th Street about a block from the school, he saw a man, later identified as Ortega, run in front of his patrol car, he said.

Lewis made a U-turn. When he turned off his lights, he saw Ortega come out from behind his car. When Ortega started running, Lewis said he chased him down.

“I grabbed him by the right shoulder and he immediately spun around and just started flailing his arms, throwing punches left and right,” Lewis said.

Lewis called for backup but was able to handcuff Ortega before other officers arrived.

During his arrest, Ortega allegedly said that the victim had wanted him to have sex with her, according to Lewis’ testimony.

Ortega appeared to be intoxicated and allegedly continued to shout statements and to threaten the officer. At one point, he allegedly said he had a knife and was going to stab all the officers, Lewis said.

At various points, Ortega also allegedly tried to bite, kick and head-butt Lewis, Lewis said.

Officers said they had to put Ortega in a wrap device to restrain him because he was so combative while they brought him back to the station, Lewis said.

Ortega was the only suspect arrested that night.

The other defendants in the case are San Pablo residents Cody Smith, 16, and Ari Morales, 17; Pinole resident Marcelles Peter, 18; and Richmond residents John Crane Jr., 43, Jose Montano, 19, and Elvis Torrentes, 22.

The three suspects who were juveniles at the time of the crime — Smith, Morales and Peter — have been charged as adults.

Richmond police officers Todd Kaiser and Gunnar Googins testified on Monday.

    I remember this story from years ago and wanted to know if anyone has any information on trial dates for these suspects? Why can I not find any follow up info on the case?

    I still think of the bystanders, people who were there and did nothing. I hope when they’re in a time of need, people don’t turn their back like they did to this young girl.
